Terms of Service

The short version. Main Street Phone provides an AI receptionist for small businesses. By using the service you agree to these Terms. You're responsible for the truthfulness of the info you give us, for complying with call-recording and telemarketing laws in your state, and for the conduct of your business. We provide the service "as is" and our liability is limited as described below.

1. Acceptance of these terms

These Terms of Service ("Terms") form a binding agreement between Main Street Phone ("we," "us") and the person or entity using our service ("you," "Business Customer"). By creating an account, connecting a calendar, or otherwise using the service, you agree to these Terms and to our Privacy Policy. If you are using the service on behalf of a business, you represent that you have authority to bind that business.

2. The service

Main Street Phone provides a virtual AI receptionist that answers phone calls placed to a phone number associated with your business, conducts a conversation with the caller using a large language model and synthetic voice, and where appropriate creates calendar events, sends notifications, and writes records to your connected systems (collectively, the "Service").

We may add, remove, or change features at any time. The Service depends on third-party providers (including voice infrastructure, language models, calendar APIs, and SMS providers); availability of the Service is subject to the availability of those providers.

The Service records and transcribes calls. Recording laws vary by state. Several states — including California, Florida, Illinois, Maryland, Massachusetts, Pennsylvania, and Washington — require all parties to a call to consent to recording.

You are responsible for ensuring that calls answered by your AI receptionist comply with applicable recording laws in the states where your callers are located. Our default greeting discloses that callers are speaking with a virtual receptionist; you must not disable or alter that disclosure unless you have substituted a disclosure that is legally sufficient in every state where your callers may be located.

6. SMS, TCPA, and outbound communications

If you direct the Service to send outbound text messages (for example, appointment confirmations, reminders, or notifications), you represent and warrant that you have obtained any consent required by the Telephone Consumer Protection Act (TCPA), state telemarketing laws, and other applicable rules before any such message is sent. We may suspend outbound messaging features if we reasonably believe they are being used in violation of law.

7. Third-party integrations

The Service connects to third-party platforms (Google, Microsoft, Jobber, Housecall Pro, and others) when you authorize us to do so. Your use of those platforms is governed by their own terms and privacy policies. We are not responsible for the availability, accuracy, or behavior of those platforms.

You may revoke access at any time from within the third-party platform or by disconnecting in our app. Revocation will cause features that depend on that integration to stop functioning.

8. Fees, billing & cancellation

Pricing for the Service is presented at sign-up and may include a subscription fee, per-minute usage charges, or both. Fees are billed in advance for subscriptions and in arrears for usage. All fees are non-refundable except where required by law or expressly stated by us in writing.

You may cancel at any time effective at the end of the current billing period. Cancellation removes the AI from active duty for your line; we will retain your account data for a reasonable period in case you wish to resume, then delete it consistent with our Privacy Policy.

We may change pricing prospectively on at least 30 days' notice. Continued use after a price change constitutes acceptance.

9. Intellectual property

The Service, the website, our software, models, prompts, voices, and branding are owned by us or our licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service for your business during the term of your subscription.

You retain ownership of your business data, configuration, and the content you provide. You grant us a non-exclusive, worldwide, royalty-free license to use that content solely to operate, maintain, and improve the Service for you.

The Service is provided "as is" and "as available," without warranty of any kind, express or implied, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or that the AI will always produce accurate or appropriate responses. AI systems can and do make mistakes, including mis-hearing callers, mis-booking, or producing incorrect information. You agree to monitor your bookings and notifications and to confirm critical details with your customers.

12. Limitation of liability

To the maximum extent permitted by law, in no event will Main Street Phone, its affiliates, or its providers be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, or business, arising out of or related to the Service.

Our total liability to you for any claim arising out of or related to the Service will not exceed the greater of (a) the fees you paid us in the twelve (12) months preceding the event giving rise to the claim, or (b) one hundred U.S. dollars (US$100).

Some jurisdictions do not allow the exclusion of certain warranties or limitations on liability, so the above may not apply to you in full.

13. Indemnification

You agree to defend, indemnify, and hold harmless Main Street Phone, its affiliates, and their officers, employees, and agents from any claim, demand, loss, or expense (including reasonable attorneys' fees) arising out of (a) your use of the Service, (b) your violation of these Terms, (c) your violation of any law or third-party right (including call-recording laws and the TCPA), or (d) any content or configuration you provide to the Service.

14. Suspension & termination

We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms, are using the Service unlawfully, or if continued service would expose us or our providers to legal or operational risk. You may terminate at any time as described in Section 8. Sections that by their nature should survive termination (including IP, disclaimers, limitation of liability, indemnification, and governing law) will survive.

15. Governing law & disputes

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles. The state and federal courts located in Hillsborough County, Florida have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service, except that either party may seek injunctive relief in any court of competent jurisdiction to protect its intellectual property or confidential information.

Class action waiver. You and we agree that any claim must be brought on an individual basis. Class actions, class arbitrations, and representative actions are waived to the maximum extent permitted by law.

16. Changes to these terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date and, where appropriate, notify you in the app or by email. Continued use of the Service after changes take effect constitutes acceptance.
